Medical & Participation Waiver

1. Nature of activities & inherent risks

Classes at House of Ki•Mi•Le involve dance, AcroDance and gymnastics, stretching and fitness training. These activities require physical exertion, balance and flexibility work, and may include partner exercises and the use of apparatus. As with any physical activity, there is an inherent risk of injury, including (without limitation) muscle strains, sprains, falls and collisions with other participants, the floor or equipment.

By accepting this waiver you confirm that participation is voluntary and that you (or the child for whom you are responsible) take part with a full understanding of these inherent risks.

2. Health declaration

The participant — or, for participants under 18, their parent or guardian — confirms that the participant is fit to take part in the activities described above, and that no medical advice has been given which would prevent participation.

You have a duty to disclose all relevant medical conditions, previous or current injuries, allergies and medication using the booking form, BEFORE the first class attended. Please keep this information up to date and tell us promptly of any change. On the basis of the information provided, the instructor may adapt activities or, on safety grounds, decline participation in particular exercises or classes.

3. Emergency treatment consent

You consent to appropriate first aid being administered to the participant in the event of injury or illness during a class, and to the emergency services (999) being contacted where, in the instructor's reasonable judgement, this is necessary.

For children, you consent to our staff acting in the child's best interests in an emergency — including arranging medical treatment — until the parent, guardian or nominated emergency contact can be reached.

4. Children & parental responsibility

For participants under 18, this waiver must be accepted by a person with parental responsibility within the meaning of the Children Act 1989. By accepting it you confirm that you hold such responsibility or act with the authority of a person who does.

Parents and guardians are responsible for ensuring that children are dropped off and picked up in accordance with the venue's arrangements, and arrive in good time before each class.

5. Medical information & UK GDPR

Medical details you provide are special category data. We process them on the basis of your explicit consent, under Article 9(2)(a) of the UK GDPR, solely to keep participants safe in class.

Medical information is stored securely within our booking system, with access limited to the instructor. It is never included in emails. We retain medical details for 24 months after a participant's last attendance, then delete them.

You may withdraw consent at any time by contacting yana@kimile.house. Please note that withdrawing consent may mean we are no longer able to offer a place, where the information is needed to keep the participant safe. Full details of how we handle personal data are in our Privacy Policy.

6. Liability & risk acknowledgment

By accepting this waiver you acknowledge the inherent risks of physical activity set out in Section 1, and agree to take reasonable care of your own safety and (where applicable) that of the child for whom you are responsible. House of Ki•Mi•Le maintains public liability insurance covering its classes.

Participants must follow the instructor's guidance at all times, wear suitable clothing and footwear, and use equipment and apparatus only as directed.

Nothing in this waiver excludes or limits our liability for death or personal injury caused by our negligence (Unfair Contract Terms Act 1977, s.2(1); Consumer Rights Act 2015, s.65), or for any other liability which cannot be excluded by law.

This waiver is an acknowledgment of the risks inherent in the activities. It does not exclude or limit any of your legal rights.

7. Acceptance & record

Ticking the waiver box on the trial booking form records this waiver — including its version and the date and time of acceptance — against the booking. You may request a copy of this page at any time by contacting us.
